Mr. Smith is an artist\nin his line of entertainment, and\nhas been endorsed by many oth\ner prominent lecturers, by noted\neducators, and by the press\nwherever he has been. M., May 4. 1010.\nTo the Board of Trustees of the Village of Alamogordo, N. M.\nAs Mayor of the Village of Alamogordo, I withhold my ap\nproval ';f Ordinance No. for the following reasons:\nThe Ordinance is entitled \"An Ordidance Amonding Section\n9 of Ordinance No. 5\" passed by the Board of Trustees of the Vil\nlage of Alamogordo, approved by the Mayor on the 15th. day on\nMarch, A. D. 1910.\nThe object of the proposed amendment is to reduce the amount\nto be paid for a retad liquor dealer's license from three thou\nsand to two thousand dollars per annum.\nOn the 15th day of March last, by a unanimous vote of the\nBoard of Trustees, theamount for said license was fixed at $8,000.00,\nAfter that and on the 5th day of April, 1910, an election was held\nfor the purpose of electing Village officers at which election the\naction of the Board in fixing the liquor license at three thousand\ndr liars was fully ratified.\nIt now appears that the Alamogordo Improvement Company\nhas succeeded in getting a majority of the Board to change their\nminds, and has secured the passage of the ordinance reducing the\namount from three to two thousand dollars.\nThe Alamogordo Improvement Company, a corporation, organ\nized under the law.-, of the Territory oi New Mexico, has, by a re\nservation m its deeds of conveyance, provided that no intoxicating\nliquors shall be sold in the town of Alamogordo, except on a cer\ntain block of ground owned by the company, and from the time of\nit) organization as a town company, it has monopolized the sale of\nintoxicating drinks in the tc.wn of Alamogordo, and it is an undis\nputed fact that at one nine, the Alamogordo Improvement Com-\npany, because of its said Bsnwopwy, reel i ved rental on its saloon\ni,iiiidiiii. a structure nut. worth to\ndollars, of six hundred dollars per\nCompany complains that it can not\nfre fixed by the Board. In other\npany asks the Board, in fixing the sum to be paid for the license,\nto take into consideration the number of drinks sold over the bar.\nIf the Board is to take into considertion the profits to be derived\nfrom the business, then I will suggest that the license he placed on\na sliding scale, so that the amount to he paid for the license shall\nbe based upon the profits of the business. Then, if the municipal\ncorporation should desire an increased revenue from the liquor\ntraffic, it should pass an ordinance requiring its officers to render\nefficient aid in building up the traffie in the sale of drinks.\nAs already stated, the Alamogordo Improvement Company has\ncreated a monopoly in itself for the sale of intoxicating drinks. It\nis therefore in no position to complain of the former action of the\nBoard of Trustees. It is an axiomatic principle of equity that a\nparty seekiug equity, \"should come into court with clean hands.\"\nIt has long been the policy of the law to restrain the sale of\nintoxicating liquors. The evil of the traffic, both in itself and in\nits influence, is recognized by the courts. \"The theory of the law\nis that it is to be tolerated only never to be encouraged.\"\nAn appeal has been made to me, that unless the license is re\nduced, we will antagonize the Improvement Company. My answer\nto this, is that I will at all times both in my official and individual\ncapacity, support the company in all its laudable undertakings,\nbut at the same time, I ask that the Alamogordo Improvement\nCompany refrain from antagonizing a majority of the people of\nAlamogordo.\nI have faith in the future of Alamogordo, but am not willing\nto assent to the proposition that its prosperity depends upon the\nsuccess or failure of a saloon.\nOn this question of liquor license, the issue is squarely present\ned as to whether or not the municipality or the Alamogordo Im\nprovement Company shall fix the amount to be paid for liquor li\ncense. Believing as I do that the power to fix the amount of license\nis vested in our municipality, and believing that a large majority\nof our people are in favor of the amount as heretofore fixed by or\ndinance, 1 decline to affix my official signature of approval to the\nordinance providing for a reduction of the amount to be paid for a\nretail liquor license.\nBy son shirk v.\nMayor.\nThe foregoing document is Kdf-explanatory. Trustees Scipio and\nEvans signed the majority report\nfavoring the passage of the\nmeasure. The majority report\nwas adopted by a vote of 3 to 1.\nS petitions which were submitted\nat the previous meeting. He\nsaid that he desired some definite\naction taken, and that if it w as\nj decided to ignore the petition,\nhe wanted to know it.\nj While the saloon license was\n1 under consideration, Mr. Park\npoke several times opposing th\npassage of the measure. In con\ncluding one of his talks, he said,\nin substance, that his own integ\nrity was above reprohch, that\nhe could neither be bought nor\ndriven. Mr. 8cipio immediately\nreplied that he wanted it dis\ntinctly understood that his ac\ntion in the mattor was influenced\nby no improper motives that he\nwas acting for what he believed\nto be the best interest of the\ncommunity in lowering the li\ncense to an equitable rate.
